Location:  The site is located on the Erf 24 and Erf 76 of Ruimsig AH, along Pierre Road in Honeydew which falls within the jurisdiction of the City of Johannesburg Metropolitan Municipality in the Gauteng Province.

Proposed Activity:  The applicant illegally commenced with listed activities (Activity 19 GN R327 and Activity 14 of GN R324) in July 2013 in terms of Government Notice R327 of the EIA Regulation, 2014 (as amended in April 2017) within a watercourse on Erf 24 and Erf 76 of Ruimsig AH. The illegal commencement of the activity has resulted in a non-compliance with Section 24 of the National Environmental Management Act (No. 107 of 1998) (NEMA), and therefore an ex-post facto authorisation process is required for the listed activity which has already taken place. The Directive issued for non-compliance pertains to the activities which include:

  • Excavation within a watercourse for the purpose of construction of weirs and culverts;
  • The installation of culverts and other flow control measures within a watercourse;
  • The construction of in-stream gabions near the existing culvert to protect the riverbank; and
  • The construction of a pedestrian bridge to the in-stream island.

Environmental Impact Assessment Process: In terms of Sections 24G and 24F of the National Environmental Management Amendment Act, the Gauteng Department of Agriculture and Rural Development (GDARD) is considering an application for rectification by Soror Language Services cc for the unlawful commencement of activities listed in terms of the Environmental Impact Assessment Regulations under the sub-regulations of Government Notice R544 of 2010. The EIA Regulations were revised in December 2014 in terms of GNR 982 – 985 and again on 07 April 2017. The rectification process will therefore be undertaken in terms of Government Notice R324 – R327 of the 2014 EIA Regulations (as amended on 07 April 2017) to obtain an ex post facto environmental authorisation.

Basic Assessment Report Available for Review: The Basic Assessment Report is available for review and comment. The report can be viewed at the Wilropark Library (Mimosa Street, Roodepoort) from 27 July 2017 to 28 August 2017. The report is also available for download at www.savannahsa.com
